DISCIPLINARY PROCEDURE AND APPEALS POLICY

  1. OBJECTIVES 

Kaiapoi Netball Club is committed to supporting everyone, including players, coaches, supervisors/managers, volunteers, whanau and supporters to participate in an environment that is respectful, safe and fair. 

  1. APPLICATION 

This policy is applicable to players, coaches, managers, volunteers, whanau, supporters and committee. 

  1. DEFINITION 

Everyone in the Club joins with good intentions and are all expected to do their best and treat each other with respect and comply with Kaiapoi Netball Club Policies and Procedures and Rules. 

  1. ACCESS TO INFORMATION 

Kaiapoi Netball Club knows everyone involved in the sport/activity is here because of a shared passion for play and for the people involved. 

Kaiapoi Netball Club is committed to support everyone, to participate in an environment that is respectful, safe and fair. 

The purpose of this policy is to provide: 

  • A process to deal with alleged breaches of the Kaiapoi Netball Club Code of 

Conduct and alleged breaches of Kaiapoi Netball Club Policies 

      ● An appeals process against a decision involving 

  • Suspension 

  • Expulsion 

  • Penalty 

  • Any other significant detriment 

It aims to: 

  • Support low-level resolution in the first instance 

  • Give clear guidance for dealing with alleged breaches and appeals 

  • Ensure the approach taken to dealing with alleged breaches and appeals is fair, including enabling culturally appropriate responses and processes 

This Policy will apply where: 

  • There is an alleged breach of the Kaiapoi Netball Club Code of Conduct or Kaiapoi Netball Club Policies 

  • The alleged breach is by a member of the Club itself or its Office Bearers 

  • Any action taken under the Disciplinary Procedure and Appeals Policy will be without prejudice to any right or remedy a member Kaiapoi Netball Club may have in law 

  • Members are always encouraged to raise any problems directly with the person (or committee) concerned, unless there are safety reasons, or the issue is too serious to try to resolve it this way 

  • Issues that can be raised informally can be dealt with under the Kaiapoi Netball 

Club Complaints Policy and Procedures 

  • Where a satisfactory outcome cannot be reached informally, or there is a serious alleged breach of the Club’s Code of Conduct or Policies, it should be raised with North Canterbury Netball Club as soon as possible 

KEY ELEMENTS OF A FAIR PROCESS 

The member complained about, or allegedly in breach: 

  • Should be told details of the allegation(s) as soon as possible 

  • Should be given a reasonable opportunity to respond to the allegation 

  • The members explanations should be fully considered before any conclusions are reached 

  • The outcome, with a summary of the allegation, the evidence considered, any expectations given and the reasons for the decision should be recorded in writing and given to the people directly involved 

If any member is found to have breached any part of the Kaiapoi Netball Club Code of Conduct or Policies one or more of the following can be imposed 

  1. Issue a written warning 

  1. Direct the member to attend counselling to address their behaviour 

  1. Withdraw any awards, placing or records sanctioned by the Club 

  1. Suspend the member from participation in any Kaiapoi Netball Club related activity
